However, Wednesday's challenge to the Defense of Marriage Act, known as DOMA, presents a more subdued day at the court, one lacking the level of fanfare seen Tuesday, which highlighted supporters and proponents of California's Proposition 8 ban on same-sex marriage.
Inside the court Wednesday, the conversation before the nine justices will have a more technical focus, examining the story of Edith Windsor, an 83-year-old New Yorker and widow who married her female partner in Canada, a marriage also recognized by the state of New York. She now seeks federal recognition of their marriage so she won't have to pay $363,000 in estate taxes because the federal government does not recognize their marriage as valid. A survivor in a heterosexual marriage would not have to pay this tax.
DOMA, signed by former President Bill Clinton in 1996, leaves recognition of same-sex marriage up to individual states. It allows the federal government not to recognize gay marriages for taxes, entitlement programs or other legal purposes, and it allows states that don't support gay marriage to ignore the unions as well.
The potential outcomes of this case, compared with Tuesday's, could be far less reaching. While the Proposition 8 case gives the court an opportunity to impose nationwide recognition of same-sex marriage, the DOMA case disputes application of federal law.
The case, Perry v. Schwarzenegger, is expected to become a landmark that eventually will be decided by the U.S. Supreme Court. Both sides have hired leading legal advocates.
San Francisco's U.S. District Judge Vaughn R. Walker, a Republican appointee known for independence and liberal thinking of the George Bush Administration, will decide whether Proposition 8's ban on same-sex marriage violates U.S. constitutional rights of equal protection and due process. Walker's pretrial rulings have tended to favor supporters of same-sex marriage. Unlike other court cases about marriage rights, the trial before Walker will involve weeks of testimony from witnesses on wide-ranging issues. Most likely, the gay side will win and President Barack Obama and the US Supreme Court will therefore have to deal with the issue when it is appealed.
Previously in 2009, On a 4-3 vote, the California Supreme Court has destroyed the civil institution of marriage between a man and a woman, and law-abiding Americans must condemn it in the strongest terms. This arrogant judicial activism took 121 pages of contorted logic to explain and is no surprise coming from this San Francisco-based court. By bowing down to homosexual activists and the rebel city of San Francisco, the California Supreme Court has exchanged the rule of law for the rule of unbridled power to destroy all that is good and sacred. However, the terrible example of homosexual weddings should be short-lived. This extremely bad ruling will certainly spur Californians to vote to overrule the judges and protect marriage licenses for men and a women in the California Constitution.

Though the 4-3 split decision by the Connecticut Supreme Court on Friday effectively redefined marriage in the state, Connecticuters will have the opportunity to have the final say if enough voters rally behind a call for the state legislature to convene a state constitution convention.
Every twenty years, under the state constitution, the ballot question "Shall there be a Constitutional Convention to amend or revise the Constitution of the state?" is placed on the ballot for consideration. This year marks Connecticut's 220th since its admission to the Union in 1788.
The Court's willingness to undemocratically impose same-sex marriage on Connecticut has made it necessary for us to demand the right to Let the People Decide, expressed Peter Wolfgang, executive director of the Family Institute of Connecticut (FIC), in a press release following Friday's high court decision.
And that is why thousands of us will vote 'yes' for a constitutional convention on November 4th.
If enough votes are found to favor a convention, it will be incumbent upon the state legislature to convene a state Constitution Convention, explained Matthew M. Daly, chairman of the Constitution Convention Campaign. There, the people of Connecticut can implement Initiative Referendum as a mechanism and amend the state Constitution for a 31st time.

Rick Warren is scheduled to pray at the Barack Obama presidential inauguration.
Warren, after praying at Barack Obama's inaugural he appears poised to be the moderate spokesman for the left of center evangelicals. Rick Warren has publicly stated that he is opposed to gay marriages. But he is trying to meet the gay lesbian community half way by not condemning them and trying to have some sort of compromise on gay marriage. Rick Warren is reaching out to the gay lesbian GLBT community and sort of apologizing for his remarks about gay marriage.
But it appears that the Reverend Rick is going out of his way to demonstrate that he is not a right wing evangelical like latter-day Anthony Comstock, Ken Starrs and James Dobsons of the Christian right. A former Iowa Supreme Court justice believes that the same-sex marriage case that the court will hear Tuesday may hinge on one of the first decisions the court will make, when they choose the standard of review to apply to the case. Those of us who believer in the Bible and listen to WAY FM Christian Radio, will be surprised on the abortion issue.
In Varnum v. Brien, six same-sex couples from Polk County are arguing that the state's 1998 ban on gay marriages is unconstitutional. The three most recent state courts to rule on gay marriage were Massachusetts, California and Connecticut. The justices in all three states ruled that laws banning same-sex marriages were unconstitutional.
McCormick said he believed the quickest ruling he could remember from the Iowa Supreme Court came in roughly three weeks.
In yet another sign that Sen. John McCain will have a difficult time being all things to all voters this year, the Family Research Council says he needs to take a higher profile in fighting against gay marriage.
In an item labeled "Not So Straight Talk Express," the advocacy group for religious conservatives took McCain to task for not making a bigger issue out of the California Supreme Court's decision establishing a right for gay couples to marry.
FRC said McCain "has managed to keep a relatively low profile on an issue that is certain to take center stage in the general election."

State lawmakers voted in May to let voters decide whether gay and lesbian couples should have the right to get married. The issue will appear on the ballot to be voted on in November 2012. State law already restricts marriage to being between one man and one woman, but such a law is subject to court challenges. A constitutional ban would be much harder to overturn.
In May, every single GOP state senator voted in favor of putting the constitutional ban on the ballot, as did all but four House Republicans. But according to the Associated Press, Few House Republicans spoke in favor of the ban .... a mayor contrast to similar debates in past years.

"I do not believe it is up to judges or even this body, but it should be up to Minnesotans," said Rep. Steve Gottwalt, R-St. Cloud, sponsor of the bill. But he said his beliefs are not paramount: "It is not about what I think. It is about what we think as Minnesotans."

Since 1934, when the Internal Revenue Code was amended to include a limitation on lobbying activities of 501(c)(3) organizations, not one church has ever lost its tax-exempt status for engaging in too much lobbying. Contacting legislators to support the passage of a constitutional marriage amendment is considered lobbying, and such activity is clearly a permissible activity of churches. Six states recognize same sex unions in some form. A Constitutional Amendment to ban same sex marriage is need to strengthen current Virginia laws and to make more difficult for court challenges. A gay or lesbian couple could marry in another state, and move to Wisconsin and request that their civil union be recognized. An anti ban is therefore needed.
Same Sex Marriage Becoming More Common
Connecticut in April became the first state to voluntarily adopt a statute similar to Vermont's, which allows same-sex civil unions. The measure, which was signed by Republican Gov. Jodi Rell, went into effect October 2005 and makes Connecticut the sixth state to give some recognition to same-sex couples. A similar measure was approved by Maryland lawmakers but vetoed by Republican Gov. Robert Ehrlich.
In Maine, voters rejected a measure placed on the Nov. 8 ballot by a church-backed conservative group, voting instead to keep a gay rights anti-discrimination law approved by lawmakers earlier this year. Alaska's Supreme Court in October ruled that state and local governments must provide the same benefits to employees' same-sex partners that spouses get.
California's Legislature broke new ground Sept. 6 when it became the first legislative body in the United States to pass a bill legalizing same-sex marriage without a court order. Republican Gov. Arnold Schwarzenegger vetoed the measure, however, saying he would rather leave it up to the state Supreme Court to decide whether California will allow gays and lesbians to wed.

Minnesota marriage amendment 2012 - Polls
48 percent in the Minnesota Poll said they favored amending state Constitution to allow marriage only between a man and a woman.
Minnesotans are deeply divided over whether the state Constitution should be amended to define marriage as only the union of a man and woman, according to a Star Tribune Minnesota Poll.
A year before they face the issue on the ballot, 48 percent of Minnesotans favor such an amendment while 43 percent oppose it. That falls within the poll's margin of error of plus or minus 4.4 percentage points.
The poll of 807 adults statewide, conducted Nov. 2-3, shows that battle lines will be drawn on clear partisan, generational, educational and geographic fractures.
Significant majorities of older voters, Republicans, voters with no college education and Minnesotans living outside of the metropolitan area support this amendment act, which would have the effect of constitutionally banning same-sex marriage in Minnesota.
Similarly, significant majorities of younger voters, Democrats, college-educated and metro-area voters oppose the amendment.
More men than women support the amendment, with 52 percent of men saying that only heterosexual marriage should be recognized while only 45 percent of women hold that view.
